Text Amendment

A text amendment to the Zoning Ordinance is necessary in order to establish limited architectural guidelines for homes in the neighborhood and to amend the restrictions for accessory dwelling units.The proposal for accessory apartments was removed from consideration due to opposition.

 

Accessory dwelling unit amendments would allow for a smaller, second unit on the property in the form of a detached structure (garage or small apartment) or a space attached to the primary residence. A key difference from the current regulations as proposed is that the primary residence does not have to be owner-occupied and those residing in the primary structure do not have to be related to those living in the accessory dwelling unit. However, both residential structures must be occupied by a single family. The proposal for accessory apartments was removed from consideration due to opposition.

 

As currently proposed, architectural guidelines for the overlay zone are general in nature and will only require staff approval at the building permit level. Appeals of staff determinations could be appealed to the Historic Preservation Board as a special Certificate of Appropriateness application. General Items of review include (for specifics, see the proposed text amendments below):

 

  • Front yard setbacks – new homes must be in line with the existing pattern of development.
  • Building heights – new primary structures must be within a 1/2 story of the homes on either side of the lot or block face.
  • Building materials – no visible plain face or split face block.
  • Roof pitch – must be similar to homes on either side of of the lot or block face.
  • Front – must incorporate a front porch, stoop, or architectural relief similar to other homes on the block face
  • Window sizes – must be similar to homes on the same block face
  • Parking – no parking spaces in the front yard, driveways only. No circular drives unless existing. Parking off alleys would still be permitted.
  • Accessory Structures – building height cannot exceed primary structure and building materials must incorporate same materials as the primary residence.
  • Fences – chain link is prohibited in front and side yards (allowed in rear yards only).
